Erika Jayne is done playing defense quietly. The Real Housewives of Beverly Hills star, 54, wants a judge to dismiss an $18 million lawsuit. Fashion designer Chris Psaila filed it in 2023.
What Chris Is Accusing Her Of
Psaila, who runs the fashion brand Marco Marco, claims that Jayne lied to the police. She said he misused her American Express card, adding about $800,000 in fraudulent charges from 2015 to 2016. He claims the accusation hurt him emotionally and harmed his business and reputation. That’s why he seeks $18 million in damages.
Erika’s Response, In Her Own Words
According to court documents obtained by TMZ on July 6, Jayne is pushing back hard on the idea that she orchestrated any kind of scheme against Psaila. She insists she never knowingly lied to investigators.
Instead, Jayne says her involvement started with a much simpler issue. She struggled to get receipts from Psaila for charges on her card. This issue is why she first spoke with investigators.
Her Legal Team Called The Lawsuit “Fantasy”
This is not the first time Jayne’s camp has pushed back on Psaila’s claims. When the lawsuit first came up, her lawyer, Evan Borges, said the accusations were baseless.
“Plaintiff’s claims against Erika are entirely without merit,” Borges said. “Independent federal prosecutors at the U.S. Attorney’s Office made the decision to charge plaintiff with crimes, no one else. The notion that Erika controlled the U.S. Government, or for that matter a Fortune 100 company such as American Express, is fantasy.”
That statement lays out Jayne’s core argument clearly. She is not disputing that Psaila faced legal trouble. She is disputing that she had the power to cause it herself.

She’s Not The Only One Being Sued Over This
Psaila is not the only Marco Marco designer with a case tied to these charges. His business partner, Marco Morante, also filed a lawsuit in Florida. This lawsuit concerns the same $800,000 of disputed credit card activity.
Jayne is now facing two related legal battles. Both stem from the same allegations. They focus on how the charges were made and who reported them.
