Kroy “KJ” Biermann Jr., the 15-year-old son of Real Housewives of Atlanta alum Kim Zolciak and former NFL player Kroy Biermann, was taken into custody this week in Fulton County, Georgia, according to Page Six and Us Weekly. He faces serious charges stemming from an incident at a fitness center in Alpharetta in April, involving a female classmate who was also a minor at the time.
Given that both the accused and the accuser in this case are juveniles, this story is being reported at a deliberately limited level of detail. KJ’s own attorney, Jason Sheffield, stated plainly that this is “not the kind of information that should be for public dissemination” precisely because those involved are minors. We’re honoring this principle by focusing on the confirmed legal facts and the public statements from both families. We won’t dive into the specific allegations in the police report.
The Legal Process So Far
KJ is being held without bond at a youth detention facility. A hearing has been scheduled for early September. Court documents obtained by Page Six indicate the incident is alleged to have occurred on April 23, and that police did not attempt to contact KJ’s father until several weeks later, first reaching Biermann on May 14 and speaking with him on May 18.
One important detail is widely reported and helps understand the case: a hospital exam the day after the incident found no male DNA in the areas the accuser mentioned. KJ’s legal team has pointed to this result as central to their defense.
KJ’s Attorney Maintains His Innocence
Sheffield issued a detailed statement asserting his client’s innocence.
“My client is 100% innocent,” he said, adding that KJ “tried to present evidence to the arresting officer, including a passed polygraph by a notable and respected sex offender polygrapher,” and claiming to have “evidence of other prior false allegations by the alleged accuser.”
He also addressed the DNA findings directly. “The officer’s report notes that investigators found no male DNA on or inside the areas the alleged victim claimed she was assaulted. The fact that he’s been arrested and is being held without bond is a tragedy,” Sheffield said. “He is not only presumed innocent, but is, in fact, innocent. I’m asking the public not to presume the truth of these allegations and to give the families on both sides their space and privacy.”
Kim Zolciak’s Statement
Zolciak released her own statement to Page Six defending her son and calling the allegations “reckless” and “deeply troubling.”
“He categorically denies ever being involved with this woman or engaging in the conduct she has alleged,” the statement read. “My son voluntarily took a polygraph examination regarding these allegations and passed. Additionally, an examination was conducted, and no DNA belonging to my son was found. We are also aware that this individual has made similar allegations involving two other people, which raises serious concerns that deserve to be carefully examined.”
Zolciak also acknowledged the difficulty of cases like this one more broadly. “False accusations can have devastating consequences, affecting both the person being accused and genuine survivors of sexual assault and abuse. Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation,” she said. “We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations.”
Page Six has also reached out to Biermann’s representative for comment.
A Difficult Contrast
The arrest comes just months after Zolciak celebrated her son’s birthday on Instagram in May. She wrote that she was “so proud of the young man” he had become and called him “one of my proudest accomplishments.”
Zolciak and Biermann, who have been navigating a contentious divorce since 2023, co-parent KJ and his three younger siblings. Due to the serious charges and the ages of those involved, the legal process, not public speculation, should find out what really happened. We’ll continue to follow confirmed developments as they become available through official channels.
