Patrick Mendes’s new custody motion in his ongoing 90 Day Fiancé divorce case made headlines for accusing estranged wife Thais Ramone of infidelity. Within days, that claim fell apart, and it’s important to lead with that correction rather than the original accusation.
Patrick, 36, filed for joint legal and physical custody of the couple’s 3-year-old daughter, Aleesi, on August 19, alleging he’d discovered in April that Thais, 29, “was involved in an affair.” But according to a statement from Thais’s attorney, Carmen Marisol, provided to Us Weekly, Patrick’s own legal team has since acknowledged the claim was a mistake.
“A motion filed earlier this week contained inaccurate factual allegations concerning alleged marital misconduct,” Marisol said. “Counsel for the opposing party has since acknowledged that those statements were included in error, and counsel for both parties have agreed that the motion will be stricken.”
Both sides also agreed to pursue Family Mediation Center services rather than continue in front of a judge, and vacated their scheduled hearing as a result.
Why This Correction Matters
A legal filing being formally struck from the record because opposing counsel acknowledged an error is a significant outcome, not a minor technicality. It means the affair claim isn’t just disputed. Patrick’s own side agreed it shouldn’t have been included as stated.
Thais’s manager, Dominique Enchinton, addressed this directly in her own statement. “Given the acknowledgment that the allegations in question were inaccurate and the agreement between both parties’ counsel to have the motion stricken, we believe it is important that the public understand that these allegations should not be treated as fact or used to misrepresent Thais or her character.”
Enchinton added that Thais has “no interest in turning a private family matter into a public dispute” and wants to move forward “respectfully and privately” for Aleesi’s sake, describing her client as having handled the situation with “an incredible amount of grace and discretion.”
The Knife Allegation Has Its Own Credibility Problem
Patrick’s motion also alleged that during the argument that led to Thais’s May 22 arrest, she “grabbed a knife and threatened” him while holding Aleesi, with the couple’s nanny allegedly witnessing it. That claim never appeared anywhere before this motion.
TMZ reports that the original police report from the arrest noted only Patrick’s claim that Thais slapped him. It made no mention of a knife at all. A serious weapon threat appeared for the first time in a custody filing three months later. Since it wasn’t mentioned in the police report, this inconsistency is important to note, not just accept as fact.
The battery charge itself, filed as a misdemeanor under Nevada law, was ultimately dropped.
Thais Has Responded, Through Representatives
Thais hasn’t spoken out directly. However, her attorney and manager strongly disagreed with Patrick’s take on the events. Her legal team’s statement made clear they consider the matter closed as far as public allegations go: “We will not be commenting further on allegations that the parties and counsel have agreed should not remain before the Court.”
TMZ said it contacted Thais directly but hadn’t heard back by publication time. This was apart from the official statements given by her representatives.
Where The Custody Case Stands Now
Despite how the affair claim played out, both sides are moving toward a resolution that doesn’t require a judge to referee the details. They agreed to use mediation instead of continuing with litigation. Both sides aim to create a custody arrangement focused on Aleesi.
Patrick’s motion changed from wanting sole custody to asking for joint legal and physical custody. This request still stands, even though the affair and knife allegations were retracted.
